Unfiled Returns and Substitute for Return (SFR)

When taxpayers fail to file, the IRS may prepare a Substitute for Return under IRC §6020(b) using third-party income data with no deductions, credits, or dependents. SFR assessments are almost always higher than what the taxpayer actually owes.

Why SFRs are punishing

The IRS files as single or married-filing-separate with standard deduction only. Cost basis is treated as zero on stock sales. No business expenses are allowed against 1099-NEC income. Balances are routinely 2–5× actual liability.

Replacing an SFR

The taxpayer files an original return for the SFR year. Once processed, the assessed SFR is abated and replaced with the correct number. This is the single most impactful step for taxpayers with multiple SFR years.

Frequently Asked Questions

Is the CSED different for SFR years?

Yes. The CSED runs from the SFR assessment date, not the original return's due date — often extending IRS collection powers.

How many years back should I file?

IRS Policy Statement 5-133 generally requires the last 6 years to be current for compliance. Filing earlier years is optional unless a refund is possible (3-year lookback) or a specific need exists.

Can I still claim a refund on old unfiled years?

Only if the return is filed within 3 years of the original due date (§6511). Refunds on older years are permanently forfeited even if the return is filed later.

Will filing an old return trigger an audit?

Rarely, and the audit risk is usually less than leaving the SFR in place. Filing replaces an inflated SFR balance with a correct number and starts a normal CSED clock.
