Collection Due Process (CDP) Hearing

Does CDP stop a wage levy?

Timely CDP filing pauses new levy action. An existing wage levy is not automatically released, but the Settlement Officer will typically address release as part of the resolution.

Can I raise the underlying liability at a CDP hearing?

Only if you did not receive — or otherwise had no prior opportunity to dispute — a Statutory Notice of Deficiency for that period. Otherwise Appeals limits review to collection alternatives.

What happens if I miss the 30-day CDP deadline?

You lose Tax Court rights and CSED tolling. You can still file an Equivalent Hearing within 1 year, but the IRS is free to levy while it's pending.
